Legal Question

Looking for for the savy advice from my Moto Houston legal advisers on the following:

Pulled over in North Oakride (Montgomery County) for a traffice stop at which time during the stop they find I have a warrant for an unpaid court fine from 2006. I tell the officer they must be wrong as I paid the fine, but he states it is what is. I get arrested, booked and jailed into the Montgomery County Jail from 4pm to 615 am the next day. I call the court in which I had the fine imposed and they tell me it went to warrant on 12/06 but was supposedly removed on 05/07 when it was paid in 2007 like I thought.

Question

1) Do I have enough for a civil suit aganist the county for Neglect
2) What type of possible damages do you think I could get?

Take anyones advice but really looking for responses from those in the now. Thanks look forward to your replies

In addition never been arrested nor in Jail in my life, and now i am afraid to leave my house as I feel like I will be pulled over again and arrested for some other paid ticket Ive had

and now you also have an arrest record. future employers will be able to see this. had a buddy get arrested on some similar BS in college. charges dropped etc...yet he still has that he got arrested on his record.

Once the charges have been dropped there is a process called expungement, that will remove any reference to your arrest record from the books.
Again you need an attorney and there is one that is a sponsor on this board.

It happened to me once like that before and no attorney would take the case unless you front them a retainer and you might or might not get it back. What to do, what to do?

OMG I just spit out my coffee. I'll agree, everyone wants something for nothing. and when the opportunity presents itself, they're all over it.

I too, would be concerned about my record, but seeking $$$ for 17 hours in the pokey is just laughable to me.

Suit being a smart little and let the man ask a question. Many many people on here have been through the same and have suggestions. I went through a similar situation about a month ago and i can honestly say that everytime i see a cop that freaks me out. I'm walking home as i type this picking my up from the cleaners cause i dont wanna risk getting pulled over.

in fact, I did my 8 or 9 hours, posted my $300 bail/fine money and went on my way. Did I about it? you bet I did.

Did I contact a lawyer for being wrongfully arrested? nope.

all of this over a traffic fine.

I guess all of you homeys find it funny to sit in a cell stripped of your dignity. Easy to say when you haventy been there. Whos going to pay for the retainer to expunge the record??
