Body shop trying to rip me off

Hey guys Im not sure how to handle this maybe someone on here can help.

I recently took my tank to a body shop and spoke to the painter who quoted me $75 given i supply the paint and I agreed. I gave him the paint and returned 2 days later to find bubbles, runs, and paint all inside my tank. I was surprised to find that the painter was actualy a little aggressive with me as if it was my fault or something for not liking it. I told him my 10 yr old sister couldve done a better job and he needs to fix it or im not paying for it. I come back 4 days later and find it done right, when i go to pay he reluctantly tells me that i owe him $400 because it was harder than he thought and he had to buy more paint.

Wtf? now is that my fault or am i missing something here? I said no way and now hes holding my tank.. Any suggestions guys? He didnt make me sign a work order, no invoice nothing..

Call the cops so he knows you're serious. A verbal agreement is still a binding contract even though it will be impossible to prove. Worst case scenario you have to pay 400 to get it back, you never know until you try.

call the cops, but don't pay the 400. like it was said. painting is his business, not yours. he should have called to let you know it was going to be way more before he proceeded anyway. Like mechanics do and such...

Without any documentation it is your word against his.

He is in a bad spot for not having documentation; but that's his doing.



As mentioned above, you may need to negotiate a price. State your arguement correctly and honestly to the officers.

I would tell him to lower it back to the agreed upon price or I will buy a new tank for 100. He isnt gonna want the tank. At the most I would offer the price of the extra paint. You shouldnt have to pay for the extra paint though. Make him think the tank is worthless.

Yep call the cops and talk things with him. Next time use a fellow member, I know several of them do paint jobs and won't bend you over (unless that is the agreed form of payment )

possesion is 9.. 10ths of the law and he has your tank.. i hate to say it but all he has to do is say that it is his tank if he wants, and that you are some phsyco out tring to take somthing from him.... i know it sounds crazy but its true and you dont have any documentation of it either i suppose, if you do then you might have a case but this guy has the upper hand now and your part... i hate to be negative but you might want try and negotiate a better price before you call the cops, because once you do it could be a deal breaker. (this is of corse if you dont have some documentation that the part is yours.)

A voice recorder is your best friend and it has saved me alot of headaches in the past.....If he holds you to that price tell him to F* off and buy another tank and get it painted for less than 400....Some people these days. Tell him you have a friend that works at a TV station and your gonna get them to run a story on how he is....I can think of plenty of things to change his mind. Lesson learned after this blows over tho, Always Always ALWAYS get that in writing.

Calling the cops won't do you any good. It is now civil matters that means you will have to take him to court. That sucks that he's out to ripped off people like that. If the paint job was looking like glass or show quality then it won't be so bad. Pm houseofpain for all your paint and body works. He is an excellent painter/body man. Did I mention that he's reasonable?
