Street legal 4-wheeler?

Ignore the massive crack in my windshield please, I never really drive this truck. Anyways I saw this on blt.8 near 59s and my son snapped a few pics. I didnt think you could regester a 4wheeler because it doesn't pass auto crash tests or have airbags. It looked to have MC tags and inspection and was wondering if this guy somehow slipped this through the cracks or is there a way to do this now?

Texas law dictates that a motorcycle can only have two (obviously) or three (like the Spyder) wheels. I don't see how this four-wheeler can be legally registered for street use? <confused>
