Remember the LED Lights?

Remember about a month ago I posted how I was pulled over and cited for having the "blue led fog lights" facing forward.

Well I went to court today.

Verdict: Case Dismissed

The DA said that led lights of any color is allowed under a couple conditions:

a. Not Flashing or strobing
b. Not to exceed 300 candlepower (which a regular headlight is under). Apparently cop cars have their flashing lights with a higher power so they project farther and brighter.
c. Preferably pointed downward.

Saying that the lesson here is that the law is still not clear and an officer still may pull you over. Yes you will win the case (just bring a copy of the legislation from the Texas DPS site, proof they don't flash) but it is just a waste of time. As for me, I did take them off, but I am just glad I won the case.

In response to RACER X's questions.

1) was it worth your time?

Yes - Because I actually got an official ruling from the State of Texas. I will also be able to write a small article on it for the magazine. that I write for. Lastly, I understand the Houston court system a little better. So yea more knowledge is always better. And now I can spread the word to the biking community.

2) was the cop there?

Yes he was there. The DA didn't even let him speak, because it was a no brainer. He really did not have any ground to stand on. The only thing he could get me on was if my lights were flashing which I proved they don't.

I didn't burn any vacation time...I am salaried. And I have a copy of the original ticket, dismissal papers, along with the state legislation on my bike from now on. So if I do get pulled over. I can show the cop the State of Texas already ruled they are legal.



But to one of your points, the "uninformed cop" may stop you but like I said carry a copy of the state legislation with you if you do have LED lights of any sort. It's like anything else, its all about how the cop wants to deal with you. My brother is a cop and he said that there really was no need to have pulled me over for something like that. Mostly likely a bored or angry cop. I don't mind the throwing, my main concern was really trying to understand what the law really says. If there is anything I learned from being in the Army is that never take things as-is.

Yea that sucks man. Not all LEO's are like that - I know plenty LEO's that are cool. I had a friend cited for "illegal lane change over single solid line". It was dismissed and the judge actually called the LEO a "misinformed ignoramus" for not knowing the law.

I leave bikes alone that have the accent LEDs granted they are solid and not flashing or strobing. Just watching out for fellow bikers. It's a safety feature IMO.

Just so most of you know as I have stated this before, court time is overtime for us in the City of Houston. Win, lose, draw.. most really don't give a if they are made to look like an or don't get to talk. We get minimum 2 hours show up pay going to court. It's $$$$$$$$$$$$$ in our pockets. You can basically get a court routine down and have a NICE paycheck every two weeks. You won't need an extra job.. Trust me on that.
You can show reference material to officers on scene. More than likely they'll all say the same . "See you in court." Why? Because it's money.

You can put the lights in the engine-bay and below the rear fender and it will give it a blue glow..!!

If you do not want them I will take them for free...!!!!
