State Trooper License Plate Relocation "written warning"

Today was out riding with a group and was pulled over by a state trooper. He was very proffesional and appropriate; however, gave me a written warning because he did not see my license plate until after he had me pulled over.

1. Has anyone else had this issue with an under seat license plate as on the attached photo (not my bike...but similar set up)

I raised the license plate higher by about 5 inches on the battery box when I got home...... Is there a record of this written warning, so if I get pulled over again a trooper may think it is still unsat so I may get a ticket?

From what I understand it has to be visible by a law enforcement officer by (X) amount of feet or yards or whatever (someone will chime in with the exact distance). So in the end, if it's tucked up under like that and the LEO doesn't see it or "chooses" not to see it until he's pulled you over, then your warning gets upgraded to a nice fat ticket.

Why not just go the safe route and move it until it's clearly visible instead of taking your chances on getting hasseled again? The aesthetics of your bike can't be worth that much (ticket-wise).

And, yes, they do keep a record of warnings. So if you get pulled again for the same thing, they'll prob think you don't give a fock.

No, they assume that if you're hiding it by tucking it up underneath, there's a reason. (running tolls, running from them, etc.)

Move it back where it's suppose to be. Save the hassle.

It is up to interpretation. Do what you want. You may get hassled, but any judge worth his salt will dismiss the ticket. Mine is under the exhaust, clearly visable, but not at "the farthest rear" of the motorcycle.

There are numerous threads on this topic. Search tool is your friend.

it's up to the officers discretion really. i've been pulled over two times (by the same cop) for not having a LP light and i have the plate in the exact same spot as you, he didn't say anything about the location of the plate and i was given a written warning the first time and a verbal warning the second time.. something along the lines of "get that thing fixed already so we can stop hanging out like this all the time", cool cop

another time i was pulled over by a trooper for not using turn signals (dont have any rear ones) and again he didn't say anything about the LP location. got a warning on the signals though. when i get back to street riding, i'm most likely going to mount it in the back with a nice bright light just to avoid being hassled.

it's not a moving violation. it's only like 90$. 90$ is 90$ but i like where mine is so i take the chance. never paid one yet, it was dismissed as the da went outside and looked at mine and laughed. it's exactly like the one in your pic.

Which brings into question why you are being hasseled in the first place.

if dont have the LP where its supposed to be then dont when you get pulled over. Its called a fender eliminator if you want to be all cool. We get hassled enough as it is. Why give them a reason to pull you over?

BTW that bike is 100% kick azz
