as long as you sign for it then you can consider yourself served, if they just drop it off then you can say you never got it, like fed ex and ups may just drop it off sometimes , is this a credit debt?

Doesn't matter how it is brought to you or by whom, what matters is that you have signed and acknowledged you are being suit.

you can be served a number of ways if it is civil, can even be in the paper. Does not have to be by the police.

yep! My half-bro didn't pay a couple of credit cards so now I guess he's being sued.

I told him to file bankruptcy.

Anybody have any other advice?

lol did he get a letter from a law firm ? its not actually a "law suit" its more of them being a term of scare tactic, uually they will just be a collector, exmple: this is the law agency of blah blah attempting to collect a debt", but none the less still a law firm, also depends how much money is involved

yup... they will accept payments to make then happy. He made the debt he needs to pay it off. even if he only give 100-200 bucks a month it will make them happy.

Bankrupcy (in this case) seems like bad advice -- my 2 cents worth. Will cost him a zillion ways for a long long long time. As the others have suggested there are better alternatives.

so no matter how many times a collection agency tries to get you to pay if it has been more than 4 years you don't have to pay? then what? contest the debt on your credit rating and have it removed?

There are laws that protect the comsumer from and how they can collect. Most violate this policy and if you can prove it then you can counter sue them back and put money in your pocket. Seriously it is just crazy, go check that board out. It is amazing what we as the consumer dont know and let collections agency get away with. They say dont talk to them on the phone do it all my mail, ie paper trail. There is ways to say pay 1/2 for removal from the credit report and then wa la you have good credit depends on the situation and some will and some wont. But dont pay a dime till they agree to have that negative trade line taken off.

J

ps I am not expert never went thru any of this myself, but just in case I like to be educated on the subject. My wife I am about to start this on, but she has like 1K max worth of . I can get that all removed and get her credit up. As for my I was dumbass and had ex's that charged my up. My stupidity and I am trying to figure a way out of it. I will try and pay half my debt in a month then get my credit back over a 750 and apply for 0% interest cards for a year and pay the rest. Once you get caught in this hole, it is hard to get out. I have a house, brand new car and all the things i need, cant take that away from me. Even with bad credit you can get a new car, just dont let the car get repo and pay on time. That is your car credit, you will pay higher interest, but you still have transportation. I have learned my lessson and will have my paid in the next year and then I can have the 250K house that I want. I pay a load of BS interest for the CC's that I have, I did it now have to pay for that mistake.

J
Jet you are the wise beyond your years. Thanks for the info! i will def. pass it along.
