View Full Version : Ticket that isnt in the system yet...

On 5/13, I got a speeding ticket at Lime Creek from Travis County (sheriff). My ticket states that I agree to appear on or before 6/13.
I have gone in three times with the latest being just now...
on 6/10, I went in to the courthouse. My ticket is NOT in the system. The legal clerk stated that the officer had not turned in my ticket yet and sometimes they take a month to do so... told me to just call or come again the following Friday, 6/17.
6/17, I went in again... no ticket in system yet. Clerk stated that the officer needs to get it in ASAP but not to worry about any warrants or whatnot.
6/30, I call only to be told that my ticket is still not in and that they would investigate.
This am, 7/5, I go in and same thing... no ticket in system. Clerk told me that I would have to get in touch with the officer myself? Huh?
I am admitting guilt of speeding. 66/40. I want to take care of this but I can't since its not in the system. Any advice?

Not with this budget crunch going on... seriously, I dont want to go to jail. I have just recently taken care of some unpaid traffic warrants so this one is a little frustrating for me because I am trying to take care of this one...

Had that happen an La. I kept calling and they say saying to call back in 6mo. after 1 year I gave up.

I am sure that the clerks did not give you anything in writing that you have presented ... lawyer up and put it in their hands.

100% in writing as well as printed out the TDD phone call. I'm Deaf so we scribbled back and forth to each other. I NEVER use my voice when dealing with courts. Just because I can speak does not mean that I can hear and THAT is where problems arise for the Deaf. Too many people make incorrect assumptions there...

I sure hope you're right. I got popped at 26 mph over the limit so I do not qualify for defensive driving (25 and under). Do you know if there is a statute of limitations?

i would check back periodically. but like others have said. he didn't turn it in, so it would appear you are off the hook.

You will have to go to court in person and request a "Defendant's Appearance Receipt." Court clerks may call it a DAR. This is official documentation from the Court that you appeared in Court to take care of the case.
You must keep this DAR or a copy with you when driving, so that if the ticket ever gets turned in, you can't be arrested on any warrant for the ticket.
After getting the DAR, you can forget about the ticket. Chances are, the officer will never turn it in and if he does, some courts require the officer to mail notice to you himself certified mail, return receipt requested, which isn't going to happen.
The Statute of Limitations on Class C is 2 years.
Also an interesting point of law is that until 2009, there was no statute of limitations on Class C misdemeanors. The statute of limitations on Class A and B has always been 2 years. But until 2009, there was nothing in the Code of Criminal Procedure Article 12.02 about Class C.
